These terms and conditions (“Terms”) govern the use of the services offered through website www.croatia-charter.hr owned by Fair Wind Ltd, Luke Botića 9, 21210 Solin, an online yacht charter agency acting solely as an intermediary between yacht charter operators and users, hereinafter referred to as the “Agency.”
By accessing or using the services provided by the Agency, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.
The Agency operates as an intermediary between users seeking to charter yachts (“Users”) and yacht charter operators (“Operators”) which offer their services on this Website. The Agency facilitates the booking process by providing Users with information about available yachts, assisting with bookings, and collecting payments on behalf of the Operators. The dynamics of payment varies depending on the Charter operator in a way that 30-50% is to be paid immediately upon confirmation of the reservation and the rest 70-50% at least 60-30 days before the start of the reservation.
Users can browse available yachts through the Agency’s website or contact the Agency directly for assistance. Upon selecting a yacht and confirming the reservation, Users must provide necessary information for booking, including dates of charter, number of guests, and any specific requirements (sailing license, VHF radio license..). The Agency will then liaise with the Operator to confirm the booking and make the Charter contract which will include all the information about the contracted service and Operator’s Terms and Conditions.
All payments for yacht charter must be made through the Agency’s bank account which will be provided in the Contract. The Agency will collect payments from Users and remit them to the respective Operators, deducting any applicable service fees agreed with the Operator. Users agree to pay the full amount as quoted by the Agency for the selected charter.
Cancellation policies vary depending on the Operator and the terms of the charter contract. Users should refer to the specific cancellation policy outlined at the time of booking. Refunds, if applicable, will be processed according to the Operator’s cancellation policy.
Users are responsible for providing accurate information during the booking process, including details of all guests and any special requirements. Users must comply with the terms and conditions set forth by the Operator, including rules regarding conduct, safety, and use of the yacht.
The Agency acts solely as an intermediary and does not assume any responsibility for the quality, safety, or legality of the yachts provided by Operators. The Agency is not liable for any damages, losses, or injuries incurred during the charter period.
The Agency collects and processes personal information in accordance with its Privacy Policy, which can be accessed on the Agency’s website. By using the services provided by the Agency, Users consent to the collection and use of their personal information as described in the Privacy Policy.
The Agency reserves the right to amend these Terms at any time without prior notice. Any changes to these Terms will be effective immediately upon posting on the Agency’s website. Users are advised to review the Terms regularly for updates.
These Terms shall be governed by and construed in accordance with the laws of Croatia. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Croatia.
By using the services provided by the Agency, you acknowledge that you have read, understood, and agree to be bound by these Terms.
